Coneqt ger inget utfallsgaranti.
9 a. Automatiserade system
10 a. Uppdragsgivarens blockering
12. Tillgänglighet
Tjänsten tillhandahålls i befintligt skick.
Belopp i villkoren.
16 a. Hela avtalet

Bilaga A — Standardvillkor för uppdrag
Terms of Use (English)
These terms apply between Coneqt and the operator or client using Coneqt. Annex A contains standard terms that apply between the operator and the client for each assignment. The Swedish text above is the reference version.
1. Parties, scope and transfer
The service is provided by Coneqt, company registration number 0210221636, Näckens väg 15, 907 53 Umeå, Sweden ("Coneqt", "we"). These terms cover all use of the Coneqt app and of the websites hub.coneqt.io and coneqt.io.
In these terms
- a client is a company or other organisation that posts assignments on Coneqt,
- an operator is an independent business that takes assignments through Coneqt, with its own F-skatt or through an umbrella company (section 3.1),
- an assignment is work a client needs done, with a time, one or more places (stops), requirements and pay, and
- a user is both operators and clients, including a client's members.
Coneqt is offered to businesses only. These are not consumer terms.
Coneqt may transfer the agreement with you, in whole or in part, to a company that takes over the business or the part of it the agreement concerns — for example a limited company Coneqt forms, or in another restructuring. We will tell you about the transfer by email. The terms, the versions you have accepted and the data recorded then continue to apply between you and the transferee. You may not transfer the agreement or your account without Coneqt's written consent.
2. Coneqt's role — intermediary, not a party
Coneqt is a digital marketplace where clients post assignments that need doing and operators can take them. Coneqt brokers the contact. This is the most important provision in these terms:
- Coneqt is not the operator's employer and not a staffing agency. Coneqt hires out no personnel.
- Coneqt is not a party to the assignment and performs no work. The assignment contract is formed directly between the operator and the client (Annex A).
- Coneqt does not set the price. Pay is set by the client or, where the assignment allows bids, by the operator.
- Coneqt does not receive or pass on payment for the assignment.
- Coneqt gives no instructions on how the work is to be done and does not train operators in the work. What is to be done, where and when, the client decides in the assignment; how it is done is for the parties.
- Coneqt requires no exclusivity. An operator may take assignments from anyone, on and off Coneqt, and is free to decline any assignment.
- The operator is not Coneqt's agent or representative and cannot bind Coneqt.
- The client is responsible for the assignment being lawful and safe to carry out, and for the permits, insurance, premises, vehicles and equipment it requires.
- The operator is responsible, as an independent business — or through its umbrella company — for its tax, contributions and insurance, and for carrying out the work in accordance with applicable rules.
Coneqt gives no guarantee of any outcome. That there are assignments in your area or within your times, that an assignment is shown to you, that you get it, that nobody else takes it first, that it is carried out and that your counterparty meets its obligations — none of that is promised by Coneqt. The market is open: everyone who meets the assignment's requirements sees the same assignment, and a client may choose someone else or cancel (section 9).
3. Account and eligibility
3.1 Operators
To hold an operator account you must
- either be a business registered for F-skatt, or carry out assignments through an umbrella company (egenanställningsföretag) that is your employer, invoices the client and pays tax and employer contributions on your pay,
- hold the valid qualification documents an assignment requires (section 4) for the assignments you take,
- be at least 18, and
- give accurate information and keep it up to date.
Whichever form you use, you are yourself responsible for the assignment being invoiced, for your tax and contributions being handled and for complying with the law.
At registration you state how you invoice (as a sole trader or company with F-skatt, or through an umbrella company), your business address and, for an umbrella company, its name and organisation number. You attest under your own responsibility that you hold F-skatt and invoice in your own name, or that you are employed by the umbrella company you named and that it invoices for your work, and that you hold the liability insurance your work requires. The attestations last twelve months and are renewed in the app. You must tell Coneqt at once if your F-skatt is withdrawn or your employment ends.
You also upload a proof: Skatteverket's certificate of F-skatt, or a certificate of your employment from the umbrella company. A person at Coneqt reviews the proof in the same way as qualification documents (section 4), and it is valid for twelve months from its issue date. The review is a formal check of the document, no guarantee of your tax status or employment.
Specifically for assignments that involve driving a vehicle: when you start the assignment you attest in the app that you have had the rest the rules require and that your tachograph card is inserted in the tachograph.
An account is personal. You may not let anyone else use it or send anyone else to an assignment you took, because qualification documents are reviewed for you personally.
3.2 Clients
A client account may be held by a registered company or other organisation with an organisation number. Coneqt may fetch the company name from Bolagsverket; that lookup is not a check of the company. The client is responsible for whom it invites as members and what permissions they get, and for everything done from its account.
The client must give accurate invoicing details — those the operator invoices against (Annex A6) and those Coneqt invoices its fee against (section 7) — and keep them up to date. Coneqt may require approved billing details before a client can post assignments.
At registration the client states whether its transports run under a goods licence (trafiktillstånd), and if so the licence number, or as own-account transport. Whoever registers the client attests on its behalf that it holds motor insurance for its vehicles and the liability insurance its transports require, that the transports run under the stated licence or as own-account transport where no licence is required, and that it takes on work-environment responsibility for operators who work through an umbrella company and checks that every operator holds the qualifications the assignment requires. They also attest their authority to represent the client (section 3.3). The attestations, except the one on authority, last twelve months and are renewed by a member permitted to edit the company's details.
A person at Coneqt verifies the client and, where its transports require a goods licence, the licence. The verification is a check against the documents and registers available to Coneqt, and no guarantee that the client meets its obligations.
Coneqt's review of the operator's proof of F-skatt or umbrella employment (section 3.1) is a formal check and moves no liability to Coneqt. Any liability arising from paying someone without F-skatt, or for work that is in substance employment (payer liability under the Tax Procedure Act), remains with the client. A client paying an umbrella company for the work pays that company, which is the employer.
3.3 Authority to bind
Whoever accepts these terms, posts an assignment or takes an assignment on behalf of a company warrants that they are authorised to represent and bind that company.
3.4 Missing details
Coneqt shows operators and clients which details, attestations and approved proofs under sections 3.1 and 3.2 are missing or have expired. From a date Coneqt decides and shows in the service, whoever is missing something cannot reserve, take, bid on or register interest in assignments, and a client missing something cannot post assignments, pick bids or have its open assignments taken, until it is completed. Until that date the service reminds but blocks nothing. The block also applies when an attestation or a proof expires, and the service shows in advance when that happens. An assignment already accepted can always be completed.
4. Qualification documents — Coneqt's review and the client's check
An assignment may require qualification documents; today a driving licence with certain categories, a YKB (Driver CPC) and an ADR certificate. The operator uploads them and Coneqt reviews them before the operator can take an assignment that requires them. The documents are checked again when the operator takes and starts the assignment; if they no longer cover the requirements at start, the assignment ends for the operator. An expired document blocks the assignments that require it until a new one is approved. The same review applies to the proof of F-skatt or umbrella employment (section 3.1); that proof is not shown to the client.
The review is a formal check that the document is legible, within its validity period and belongs to the account holder. It is no guarantee that the document is genuine or not revoked, or that the operator is competent or suitable.
The client is itself responsible for checking that the operator holds the qualifications the assignment requires — for example by seeing the original driving licence, YKB card and ADR certificate when the assignment begins and checking that the categories cover the vehicle and goods concerned. After acceptance the client sees the operator's approved documents and their expiry dates in Coneqt.
The operator warrants that uploaded documents are genuine and valid, and must tell Coneqt immediately if a document is revoked, withdrawn or ceases to be valid. Coneqt is not liable if a document turns out to be invalid, revoked or forged.
5. How an assignment works
5.1 Before acceptance
Operators who meet the assignment's requirements see it on the market. It shows the time window, the pay and pricing form, the requirements, the kinds of stop and, where relevant, the vehicle class. For each stop an approximate area is shown (a grid cell, the first three digits of the postal code and the town). The place where the assignment begins is shown exactly, but without an address, name or contact details; it may be the client's own site. The client's identity is not shown before acceptance.
5.2 How an assignment is taken
Specifically for assignments that involve driving a vehicle: when posting an assignment the client attests that it is planned so that it can be carried out within the driving and rest time rules and, where the assignment requires ADR, that the goods are classified, packed and marked under ADR and that the transport documents come with the assignment.
When posting, the client chooses how the assignment is taken:
- First to accept (fixed price). The operator reserves the assignment and then confirms it. During the reservation, which lasts a short time, nobody else can take it. If the reservation lapses or is released, the assignment returns to everyone, and the operator waits a short while before it can reserve the same assignment again.
- The client picks (fixed price). The operator registers interest. Registering interest is a bid at the stated price and can be withdrawn until the client has picked. Until it picks, the client sees only the interested operators' anonymous merit profile: rating, completed assignments, reliability badge, qualifications and the number of exits and no-show marks in the last 180 days. The operator picked gets the assignment at once.
- Bidding. The operator bids its own price before a bidding deadline, which falls no later than the assignment's start. Other invitees can see that someone is ready to do the assignment at the stated price, but never who or how many.
- Negotiable price. The operator proposes a price, with no bidding deadline.
On assignments with bids, the client chooses which bid to accept. Coneqt may in some cases allow counter-offers on fixed-price assignments.
A bid is a binding offer to carry out the assignment on the stated terms. Confirming an assignment, being picked for one you registered interest in, or having your bid accepted, is a contract between the operator and the client on the assignment's terms and the terms in Annex A.
An operator cannot take an assignment that overlaps one it already has.
5.3 Times
An assignment can only be taken before its start time. Once the start has passed it leaves the market; a reservation made before the start can be confirmed while it lasts. An assignment cannot be posted with a start time that has already passed. The operator can start the assignment in the app at the earliest 30 minutes before the time window and at the latest when it ends. An assignment that has been started can be finished after its time window has ended, for example when traffic or waiting at a stop makes it run late. Stops can be checked off and the assignment completed until it is done.
5.4 What is shown after acceptance
The operator receives the client's name and organisation number, contact person and phone number, the exact addresses and contacts for every stop, references and instructions and — when the assignment concerns a vehicle — the vehicle's description and registration number. The operator also receives the client's invoicing details: address, invoice email, VAT number, invoice reference and payment terms.
The client receives the operator's name, phone number and profile photo, the merit profile and the approved qualification documents with their expiry dates. The client also sees who invoices: the operator, by name, or the umbrella company, by name and organisation number. A sole trader's organisation number is not shown. The client sees which attestations the operator has given and when, including the one given at start.
5.5 Carrying out and completing
The operator starts the assignment in the app, and gives the attestation section 3.1 requires. An assignment cannot be started by an operator whose account has been suspended or whose access to the market has been revoked (section 11). From start to completion the operator's position is recorded and shared with the client, who also sees when the operator arrived at and left each stop, derived from the positions (see the privacy policy). Position is recorded only within the assignment's window.
The assignment is completed when the operator marks the last stop as done. The client does not confirm completion in Coneqt; any objection to the work is raised with the operator under Annex A6. About 20 minutes after completion Coneqt creates a receipt: a checksum over the assignment's data, the positions and the chat (see section 13c).
The parties may then rate each other (section 10).
6. Pay and payment
- Coneqt sets no prices and gives no price recommendations. Pay is what the assignment states or what the accepted bid says. The total cost shown to the client is the pay plus Coneqt's fee (section 7) and does not affect the pay.
- Coneqt does not handle payment and is not a payment service provider.
- The operator — or its umbrella company — invoices the client directly and keeps the full agreed pay.
- Payment terms and payment disputes are between operator and client (Annex A6).
7. Coneqt's fee
Coneqt charges the client a platform fee for each assignment completed, and for an accepted assignment the client cancels 48 hours or less before the start time. The operator pays no fee, and the fee is never deducted from the operator's pay.
Amount. The fee is 15 per cent of the assignment's agreed pay excluding VAT, with VAT added. Agreed pay means the pay when the assignment was accepted: the price the assignment was posted with, a price changed before the assignment was accepted, or the bid accepted in Coneqt. On a cancellation the fee is calculated on the agreed pay.
The client sees the fee and its total cost — the agreed pay plus the fee, excluding VAT — before the assignment is posted and before a bid is accepted. The operator sees the agreed pay, which is the amount the operator invoices.
When no fee is charged. No fee is charged when the operator leaves the assignment or is marked as a no-show, when the client cancels more than 48 hours before the start time, or when an assignment ends before anyone has accepted it.
Changes to the fee. Coneqt may change the fee rate, its basis of calculation, any minimum or maximum amount and the invoicing terms. A change that increases the fee is notified at least 30 days before it applies, in the manner set out in section 16; a reduction may apply at once. The rate in force when an assignment was posted applies to that assignment, even if the rate later changes. An assignment that is posted again is subject to the rate in force when it is posted again. If the client does not accept an increase, it may close its account free of charge before the increase applies; assignments already posted and accepted are then completed and invoiced at the previous rate.
Invoicing. The fee is invoiced to the client monthly in arrears, payable within 30 days. The fee is Coneqt's consideration for its intermediation service. It is not part of the operator's pay, and Coneqt does not influence what pay the parties agree.
Pay for the assignment agreed outside Coneqt in order to avoid the fee is a breach of section 8.
8. Acceptable use
You may not
- give false information or upload forged documents,
- use Coneqt to circumvent the F-skatt requirement or for arrangements that are employment in practice,
- contact the counterparty outside Coneqt to avoid the fee for an assignment brokered through Coneqt,
- collect, scrape or pass on data about other users,
- try to circumvent the identity and exact-location protections before acceptance,
- harass, threaten or discriminate against other users, or
- disrupt the service, test its security without permission or bypass access controls.
9. Leaving, cancelling and no-shows
If you as an operator cannot carry out an accepted assignment, leave it in the app as early as possible. That is possible until you start the assignment. You give a reason from a fixed list, the client is notified and the assignment returns to the market.
Each exit is recorded and weighted by notice: at least 24 hours before the start 1, less than 24 hours 2, after the time window has opened 3. If you do not show up and have not left the assignment, the client may mark you as a no-show, at the earliest 30 minutes after the start. That weighs 4.
Exits and no-show marks over the last 180 days make up your reliability. You can dispute a no-show mark in the app once, within 14 days; a person at Coneqt reviews the dispute, and if it is upheld the mark does not count. Coneqt may also strike an exit in other cases, stating the reason.
The client may cancel an accepted assignment until you start it, giving a reason from a fixed list. The cancellation is recorded, you are notified, and it does not count against your reliability. Coneqt's fee applies when the cancellation is made 48 hours or less before the start time (section 7).
Cancellation fees between operator and client, if any: Annex A5.
9a. Automated systems
Coneqt uses automated systems in the following cases, and only these:
- Which assignments you are offered. You are offered an assignment only if your approved qualification documents meet its requirements, you do not already have an overlapping assignment, the client has not blocked you (section 10a), you are not a member of the client, and you have not reached the cap below. Everyone who meets the requirements is offered the assignment at the same time. If you become eligible while the assignment can still be taken, you are offered it automatically.
- Cap per client: an operator is not offered new assignments from a client once it has completed 8 assignments for that client in the last 30 days, so that a recurring collaboration does not become employment in practice.
- Reservations lapse automatically after a short time and are followed by a short wait for the same assignment (section 5.2). Assignments leave the market automatically at their start time.
- Reliability: exits and no-show marks are given points under section 9. The number over the last 180 days is shown to clients.
- Reliability badge: given automatically to an operator with at least 20 completed assignments, no reported damage and no exit points in the last 180 days.
- Score per offer: for each offer Coneqt computes and stores a value with an explanation — your average rating (3.5 if you have no ratings yet), +0.2 with the reliability badge, −0.25 per exit point and at most −1.5 in total. Today the value does not decide who is offered an assignment, in what order, or how assignments are shown; if that changes you will be told in a new version of these terms.
- Market order: assignments you can take are shown first, sorted by the distance from the centre of your map area to the assignment's starting point, then by deadline. The order uses no data about you beyond the area your map shows.
- Drive-time aid: during an assignment in progress that involves driving a vehicle, the app automatically works out driving, other work and breaks from the assignment's positions (see the privacy policy). The result is shown to you only and does not affect which assignments you are offered.
- Notifications are sent automatically, for example about new assignments, changes and reminders.
No automated system suspends or restricts an account. Such decisions are taken by a person at Coneqt under section 11. You can at any time ask for an explanation of an automated outcome that concerns you and have it reviewed by a person at Coneqt, via support@coneqt.io.
10. Ratings
After a completed assignment the parties may rate each other, once, with scores 1–5. The client rates punctuality, care of vehicle and equipment, communication and overall, and states whether damage occurred. The operator rates clarity of instructions, condition of vehicle and equipment, payment and overall. There are no free-text fields, and a rating once given cannot be changed. A client with completed assignments it has not rated may have to rate them before posting new ones.
Ratings are not removed at the request of whoever received a low score. Coneqt may remove ratings given for a manifestly improper purpose.
10a. Blocking by a client
A client may block an operator from its assignments. The operator is then not offered the client's assignments, and its reservations, interest and bids on the client's open assignments are withdrawn. Accepted and in-progress assignments are not affected. The operator is not separately told about the block. A block is the client's own decision, not Coneqt's, and does not affect the operator's reliability or ability to take other clients' assignments.
11. Restriction, suspension and termination
You may stop using the service and delete your account at any time (see delete account). A client closes its account when its last member deletes their account. Deletion is not possible while an assignment is accepted or in progress.
Coneqt may restrict an account's access to the market or suspend the account for breach of these terms, suspected fraud, forged documents, invalid qualification documents, repeated exits, or where continued use endangers others' safety. The decision is taken by a person at Coneqt. When an account is restricted or suspended, you are told at the same time by email, with the reason for the decision.
Coneqt may terminate the agreement with you on 30 days' notice. For a serious or repeated breach, suspension may take effect without notice.
You can ask for a decision to restrict, suspend or terminate to be reviewed by emailing support@coneqt.io within 30 days. A person at Coneqt other than the one who took the decision reviews it, and you receive a reasoned answer.
When an operator's account is suspended or its access to the market is revoked, assignments accepted but not started return to the market, which the client sees in Coneqt. This does not count against the operator's reliability. An assignment in progress may be completed. Otherwise suspension does not affect obligations for assignments already accepted or carried out.
12. Availability
The service is provided as is. We give no guarantee of uninterrupted or error-free operation. Maintenance, faults at subcontractors, faults in the user's device or network and circumstances beyond our control may cause interruptions or missing data.
Maps, geocoding and routing are built on third-party data, including OpenStreetMap, which we reproduce without warranting that it is accurate, complete or current. The same applies to other data the service takes from sources outside our control.
13. Limitation of liability
Coneqt brokers contact and is therefore not liable for
- how an assignment is carried out, or for injury or damage to persons, goods, vehicles, premises, equipment or third parties,
- a party paying, invoicing correctly or performing its contract,
- a party not showing up, leaving an accepted assignment, cancelling it, being marked as a no-show, being blocked or receiving a particular rating, or loss following from it,
- the accuracy of information a user provides, or a qualification document being genuine and valid (section 4),
- sanction fees, fines, taxes or charges imposed on a user,
- how a user processes data it received through Coneqt (section 14a), or
- indirect loss such as lost profit, loss of production or lost assignments.
Coneqt's total liability to a user is in all cases limited to the lower of (a) the fees the user paid to Coneqt in the twelve months before the event the claim is based on and (b) SEK 100,000. For an operator, who pays no fee, liability is limited to SEK 10,000. Claims against Coneqt must be made in writing within six months of the user noticing, or when it ought to have noticed, the grounds for the claim.
These limitations do not apply in case of intent or gross negligence, or where mandatory law provides otherwise.
The drive-time aid is advisory. The tachograph is always the legal record of driving and rest times, and Coneqt is not liable for sanctions following from reliance on the aid.
13a. Indemnity
You shall hold Coneqt harmless against claims, sanction fees, taxes, charges, damages and reasonable costs — including legal costs — brought against Coneqt by a counterparty, a third party or an authority and arising from
- an assignment you posted, took or carried out,
- your breach of these terms or of the law,
- your obligations as an employer, client, payer or business, including tax, employer contributions and payer liability, or
- information or documents you provided.
Coneqt shall notify you of such a claim without delay and let you take part in its defence.
13b. Insurance
The client must hold the insurance the assignment requires — for example motor third-party, vehicle-damage and liability insurance when the assignment concerns a vehicle, and carrier's liability insurance when it concerns goods — and ensure it also covers an operator who is not the client's employee carrying out the assignment.
The operator must hold business liability insurance, or be covered by one through its umbrella company.
Minimum insured amounts: the client must hold motor third-party insurance as required by law and liability insurance of at least SEK 10,000,000 per incident.
13c. Disputes between users and assignment data as evidence
Disputes about an assignment are settled between the operator and the client. Coneqt is not a party to them and does not decide them.
Data you have access to in Coneqt — positions and the trail, the times of start, arrival, departure and completion, the receipt, chat, images and voice messages — may be used as evidence that work was done. Coneqt gives no guarantee, however, that the data is accurate, complete or available at any given time:
- positions may be missing or wrong because of the device, reception, operating-system restrictions or the app being closed,
- the service may be unavailable (section 12), and
- data is deleted when the retention period in the privacy policy ends.
Coneqt has no duty to keep data longer than that, to produce it on request or to certify it, and is not liable if a claim cannot be proven because data is missing or wrong. Each party must keep the records it needs itself — for example tachograph data, invoicing records and delivery notes. Coneqt may disclose data about an assignment where the law, a court or an authority requires it, without becoming a party to the dispute.
14. Personal data
How we process personal data is set out in the privacy policy. The client is an independent controller for the data it receives about an operator, and the operator for the data it receives about the client and about contacts at the stops.
14a. Data — rights and handling
Coneqt owns all rights to the service and to the data the service creates and compiles: the database, assignment and position data, ratings, reliability data, receipts, statistics and anything derived from them. You grant Coneqt a royalty-free, irrevocable, perpetual, worldwide, transferable and sublicensable right to store, use, process, compile and derive data from all content and data you provide, upload or create in the service — for example messages, images, voice messages, documents, assignments, bids and positions — for any purpose relating to Coneqt's business, including providing, developing, documenting and analysing the service and producing statistics. The right survives the end of the agreement and the deletion of your account.
Personal data is not property. What is said here applies within the General Data Protection Regulation and the privacy policy: your rights as a data subject — among them to access, rectify and erase your data — take precedence, and data relating to an individual is kept and de-identified as the privacy policy sets out. Once de-identified, and for data that is not personal data, Coneqt's right applies without limit in time.
Each user is itself responsible for how it processes data it received through Coneqt — for example screenshots, exports, forwarding and storage in its own systems. Coneqt is not liable for another user's processing, and is liable for loss or corruption of data only within section 13.
15. Reporting illegal content
Report content you believe is illegal, for example in a chat, to support@coneqt.io, saying where it is and why it is illegal. We review the report and tell you the outcome.
16. Changes to these terms
We may change these terms. Every version has a version number and a date, and earlier versions remain available to read.
- We send the new text in full by email before it applies: to operators at the account's email address, and to clients at the client's administrators and invoicing address.
- A change that is more than editorial applies at the earliest 15 days after we sent it. A purely editorial change may be published without advance notice.
Amounts in these terms. Coneqt may in the same way change the amounts and limits stated in these terms, including the fee (section 7), the limitation of liability (section 13), the insurance requirements (section 13b) and the rules and amounts on cancellation (section 9 and Annex A5). A change to your disadvantage is notified at least 30 days before it applies; a change solely to your advantage, or required by law or by a decision of an authority, may apply sooner. A change never affects
- an assignment already accepted — the terms and the version of Annex A in force at acceptance apply to it,
- a fee that has already accrued, or
- a claim based on something that happened before the change applied.
If you terminate before the change applies, you do so free of charge.
- If you do not accept the change, you can close your account under section 11 before it applies.
- If you continue to use the service after the change applies, you accept the new terms.
16a. Entire agreement
These terms and Annex A are the whole agreement between you and Coneqt about the service. What else the app shows, an answer from support, a screenshot, a store listing or something a member of staff has said in writing or orally adds nothing, warrants nothing and changes nothing — unless it expressly points at a section of these terms.
17. Governing law and disputes
Swedish law applies. Disputes are settled by the Swedish general courts with Stockholm District Court (Stockholms tingsrätt) as the court of first instance.

Annex A — Standard terms for assignments
A1. Application
This annex applies between the operator and the client for each assignment brokered through Coneqt, unless they have agreed otherwise in writing. Coneqt is not a party to the assignment contract and is not liable for its performance. The contract is formed under section 5.2. If the operator carries out the assignment through an umbrella company, that company is the client's counterparty for the pay, and the operator does the work.
A2. The client's responsibility
The client is responsible for
- the assignment being lawful and correctly described, and for the operator receiving the instructions, information and access to places that are needed,
- premises, vehicles, machinery and equipment it provides being safe, inspected, insured and in lawful condition,
- the permits its business requires, and
- the working environment at the places it controls.
In particular for assignments that involve driving the client's vehicle: the client is the transport undertaking and operator and is responsible for the operating licence where one is required, for the load, load securing, weights and dimensions, for dangerous-goods documents, for downloading tachograph data from the vehicle, and for planning the assignment so that the driving and rest-time rules can be kept (Article 10 of Regulation (EC) No 561/2006). Charges the law imposes on the vehicle's owner or the transport undertaking — for example overload fees — are borne by the client.
A3. The operator's responsibility, working time and working environment
The operator must carry out the assignment competently, follow the client's instructions on what is to be done, where and when, and comply with applicable rules. Fines and sanction fees imposed on the operator personally for its own conduct are borne by the operator.
In particular for assignments that involve driving a vehicle: the operator is responsible for keeping the driving and rest-time rules and for using its own driver card and the tachograph correctly, and must before the assignment tell the client the driving and working time it already has in the period, so that the assignment can be planned lawfully. The client records the working time for the assignment where the law requires it.
Umbrella companies: if the operator carries out the assignment through an umbrella company, that company is the employer, with the obligations that follow. For the assignment, the client carries the work-environment responsibility of a company hiring in labour (Chapter 3, Section 12 of the Swedish Work Environment Act).
A4. Damage
Damage to the client's property, vehicles and goods, and to third parties, arising during the assignment is compensated primarily through the client's insurance (section 13b). The operator is liable to the client for such damage only if caused intentionally or by gross negligence, and then at most up to SEK 25,000. The client is liable to its own customers for the assignment as a whole.
A5. Cancellation and no-shows
Exits, cancellations and no-show marks follow section 9. Compensation on cancellation or no-show: none. Beyond that, neither party owes the other compensation for an assignment cancelled or left under section 9.
A6. Invoicing, payment and objections
The operator — or its umbrella company — invoices the client after the assignment is completed, against the invoicing details the client has given in Coneqt and with the agreed pay. Payment is made on the client's stated payment terms, but no later than 30 days after the invoice date. Late payment carries interest under the Swedish Interest Act (räntelagen).
Objections to how the assignment was carried out must be raised with the operator in writing within 14 days of completion. Coneqt does not decide objections.
A7. Confidentiality
The operator must keep confidential the information about the client's business, customers, addresses and routines it learns through the assignment, also after the assignment, unless the information is already public.
A8. Personal data
Each party is an independent controller for the personal data it processes for the assignment.
A9. Governing law and disputes
Swedish law applies. Disputes between the operator and the client are settled between them, without Coneqt, by the Swedish general courts with Stockholm District Court as the court of first instance unless the parties have agreed otherwise.
